Welcome to DrNathX AI (“DrNathX AI”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of the DrNathX AI website (www.drnathxai.com), platform, applications, tools, AI services, and related products (collectively, the “Service”).
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years of age to create an account or use the Service. By using DrNathX AI, you represent and warrant that you are 18 or older and legally capable of entering into a binding contract.
2. Your Account
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You agree to provide accurate, current, and complete information during registration.
- You must notify us immediately of any unauthorized use of your account.
3. The Service
DrNathX AI provides an AI-powered ecosystem for research, content creation, publishing, marketing, advertising, learning, and commerce. Features are released progressively and may be added, modified, or removed at our discretion.
We do not guarantee the accuracy, completeness, or reliability of AI-generated output. You are solely responsible for reviewing, verifying, and using any content generated through the Service.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful, harmful, fraudulent, or deceptive purpose.
- Generate content that is defamatory, discriminatory, hateful, harassing, sexually explicit involving minors, or that incites violence.
- Infringe on the intellectual property, privacy, or other rights of any person or entity.
- Attempt to reverse-engineer, decompile, or extract source code from the Service.
- Use automated means (bots, scrapers) to access the Service without written permission.
- Resell, sublicense, or redistribute the Service without authorization.
- Upload malware, viruses, or any code that could harm our infrastructure or other users.
Violation may result in immediate account suspension or termination without refund.
5. AI-Generated Content
- Content you generate using DrNathX AI (“User Output”) is provided to you subject to these Terms.
- You retain ownership of the ideas, prompts, and inputs you submit.
- You grant DrNathX AI a non-exclusive, worldwide, royalty-free license to use anonymized and aggregated inputs and outputs to train, improve, evaluate, and develop our AI models and Service. See our Privacy Policy for details, including how to opt out where applicable.
- You are solely responsible for the legality and use of any content you generate.
- AI output may occasionally be inaccurate, biased, or offensive. We provide no warranty as to its correctness or fitness for any purpose.
6. Subscriptions, Payments, and Credits
- Paid plans are billed on a recurring basis (monthly or annually) unless otherwise specified.
- All prices are exclusive of applicable taxes unless stated otherwise.
- You authorize us (and our payment processors) to charge your chosen payment method for all fees.
- Subscriptions renew automatically. You may cancel at any time through your account settings.
- AI credits, where applicable, are non-transferable and expire at the end of each billing period unless otherwise stated.
- Founder’s pricing, if offered, is subject to the terms disclosed at sign-up.
7. Refunds
Please refer to our Refund Policy for full details. Briefly: eligible refunds may be requested within 14 days of purchase, subject to conditions.
8. Third-Party Services
The Service may integrate with third-party services (e.g., payment processors, advertising networks, AI providers). We are not responsible for the availability, accuracy, or practices of third parties. Your use of third-party services is governed by their own terms.
9. Intellectual Property
- The Service, including all software, design, branding, and content, is owned by DrNathX AI and protected by copyright, trademark, and other laws.
- You may not use our name, logo, or branding without prior written consent.
10. Termination
- You may close your account at any time.
- We may suspend or terminate your account without notice if you violate these Terms, misuse the Service, or engage in fraudulent activity.
- Upon termination, your access to the Service will cease. Certain provisions of these Terms (e.g., ownership, disclaimers, liability limits) survive termination.
11. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI outputs will be accurate.
12. Limitation of Liability
To the maximum extent permitted by law, DrNathX AI, its founder, contributors, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising from your use of the Service.
Our total aggregate liability for any claim shall not exceed the amount you paid to DrNathX AI in the twelve (12) months preceding the claim, or USD $100, whichever is greater.
13. Indemnification
You agree to indemnify and hold harmless DrNathX AI from any claims, damages, or expenses arising from your use of the Service, your User Output, or your violation of these Terms.
14. Changes to the Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in the courts of Benin City, Edo State, Nigeria, unless otherwise required by applicable consumer protection law.
